The purpose of these general terms and conditions of use (hereinafter referred to as the "GTCU") is to provide a legal framework for the terms and conditions under which Lowdout makes the site and services available and to define the conditions of access to and use of the services by the "User".

These GCU are available on the site under the heading "GCU".

Any registration or use of the site implies the user's unreserved and unrestricted acceptance of these GCU. When registering on the site via the Registration Form, each user expressly accepts these GCU by ticking the box preceding the following text: "I acknowledge that I have read and understood the GCU and I accept them".

In the event of non-acceptance of the GCU stipulated in this contract, the User must renounce access to the services offered by the site.

https://lowdout.gg reserves the right to unilaterally modify the content of these GCU at any time.

ARTICLE 2: Access to the site

The website offers the following services:

The provision of SaaS (Software as a Service) access to a management platform dedicated to esport teams. Services include access to an administrative dashboard, planning tools (shared calendar, organisation of scrims), management of team members (roster), as well as performance analysis and video review functions (VOD).

The site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User's expense.

Non-member Users do not have access to the reserved services. To do so, they must register by filling in the form. By agreeing to register for the reserved services, the member User undertakes to provide truthful and accurate information about their civil status and contact details, in particular their email address.

To access the services, the User must then identify himself using his login and password, which will be sent to him after registration.

Sessions actives. L'Utilisateur peut consulter et révoquer à tout moment ses sessions actives sur account.lowdout.gg/security. La révocation d'une session est effective dans un délai inférieur à une (1) heure.

Any User member who is regularly registered may also request to be removed from the list by going to the dedicated page in their personal space. This will take effect within a reasonable period of time. Https://lowdout.gg shall not be held liable for any event due to force majeure resulting in a malfunction of the site or server, subject to any interruption or modification in the event of maintenance. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without prior notice.

ARTICLE 3: Data collection

The site ensures that the User's personal information is collected and processed with due respect for privacy in accordance with the French Data Protection Act no. 78-17 of 6 January 1978.

In accordance with the French Data Protection Act of 6 January 1978, Users have the right to access, rectify, delete and object to their personal data. The User may exercise this right:

ARTICLE 4: Intellectual property

Trademarks, logos, signs and all site content (text, images, sound, etc.) are protected by the French Intellectual Property Code and, more specifically, by copyright.

The User must request prior authorisation from the site for any reproduction, publication or copying of the various contents. The User undertakes to use the content of the site in a strictly private context; any use for commercial or advertising purposes is strictly prohibited.

Any total or partial representation of this website by any means whatsoever without the express authorisation of the website operator shall constitute an infringement punishable under article L 335-2 et seq of the French Intellectual Property Code.

In accordance with article L122-5 of the French Intellectual Property Code, Users who reproduce, copy or publish protected content must cite the author and source.

ARTICLE 5: Liability

The sources of the information published on the https://lowdout.gg site are deemed reliable, but the site does not guarantee that it is free from defects, errors or omissions.

The information provided is for general guidance only and has no contractual value. Despite regular updates, the https://lowdout.gg website cannot be held responsible for any changes in administrative or legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained on this site.

Users are responsible for keeping their password secret. Any disclosure of the password, in whatever form, is prohibited. The User assumes all risks associated with the use of his/her login and password. The site declines all responsibility.

The https://lowdout.gg website cannot be held responsible for any viruses that may infect the user's computer or hardware following use, access or downloading from this site.

The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

ARTICLE 6: Hypertext links

Hypertext links may be present on the site. Users are informed that by clicking on these links, they will leave the https://lowdout.gg site. The latter has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

ARTICLE 7: Cookies

Users are informed that when they visit the site, a cookie may be automatically installed on their browser.

Cookies are small files stored temporarily on the hard disk of the User's computer by your browser and which are necessary for the use of the https://lowdout.gg website. Cookies do not contain any personal information and cannot be used to identify anyone. A cookie contains a unique identifier that is randomly generated and therefore anonymous. Some cookies expire at the end of the User's visit, others remain.

The information contained in cookies is used to improve the https://lowdout.gg website.

By browsing the site, the User accepts them.

The User may deactivate these cookies using the settings in their browser software.

ARTICLE 8: Publication by the User

The site allows members to publish the following content:

In their publications, members undertake to respect the rules of Netiquette (rules of good conduct on the Internet) and the rules of law in force.

The site may moderate publications and reserves the right to refuse to publish them online, without having to justify this to the member.

The member remains the owner of all intellectual property rights. However, by publishing a publication on the site, he/she grants the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, broadcast and distribute his/her publication, directly or through an authorised third party, throughout the world, on any medium (digital or physical), for the duration of the intellectual property. In particular, the Member grants the right to use his or her publication on the Internet and mobile telephone networks.

The publishing company undertakes to include the member's name close to each use of its publication.

Any content put online by the User is his/her sole responsibility. The User undertakes not to put content online that may harm the interests of third parties. Any legal action taken by a third party against the site will be borne by the User.

The User's content may be removed or modified by the site at any time and for any reason, without prior notice.

ARTICLE 9: Applicable law and jurisdiction

French law applies to this contract. In the event of failure to resolve a dispute between the parties amicably, the French courts shall have sole jurisdiction. For any question relating to the application of these GCU, you may contact the publisher using the contact details given in ARTICLE 1.

ARTICLE 10: API Request Logging

For the proper functioning, security and improvement of the service, the https://lowdout.gg website automatically collects certain technical data for each request made to the API (Application Programming Interface).

The data collected is as follows:

  • HTTP method used (POST, PUT, DELETE, PATCH)
  • Request URL (without query parameters)
  • HTTP response status code
  • User identifier (if the user is authenticated)
  • User's IP address
  • User agent (browser/application type)
  • Request processing duration in milliseconds
  • Error message if applicable (truncated to 1000 characters)

This data is collected on the legal basis of the legitimate interest of the data controller to ensure security, debugging and continuous improvement of the platform.

Retention period: API logs are retained for a maximum of 30 days, after which they are automatically and permanently deleted.

This data is not used for advertising profiling purposes nor shared with third parties for commercial purposes.

ARTICLE 11: Cookieless Analytics (Umami)

The https://lowdout.gg website uses Umami, a privacy-respecting analytics solution that operates without cookies.

Umami anonymously collects the following data:

  • Pages visited
  • Traffic source (where the visitor came from)
  • Device type (mobile, tablet, computer)
  • Browser type
  • Country of origin (approximate geolocation based on IP)
  • Visit duration

Collection characteristics:

  • No cookies are placed on the user's device
  • No personally identifiable information is collected
  • No cross-site tracking is performed
  • Data is aggregated and anonymized

This collection is carried out on the legal basis of the legitimate interest of the data controller to understand the use of its service and improve it.

In accordance with CNIL recommendations, no prior consent is required for this audience measurement as it is strictly anonymous and does not allow tracking of the user beyond their session.

ARTICLE 12: Riot Games Intellectual Property

Lowdout is not endorsed by Riot Games and does not reflect the views or opinions of Riot Games or anyone officially involved in the production or management of Riot Games properties. Riot Games and all associated properties are trademarks or registered trademarks of Riot Games, Inc.

ARTICLE 13: Desktop Application and Third-Party APIs

The Lowdout desktop application uses the local APIs of the Riot Games client (LCU) and public data (Data Dragon) to provide overlay and game enrichment functionality.

Using game data :

  • The application interacts in read-only mode with the game client locally on your machine to synchronise notes and replays.
  • No personal identification data (password, Riot email) is collected or transmitted to our servers via these APIs.
  • Only the game metadata (champion IDs, timestamps, game events) required to run the 'Live Notes' and 'Match History' features are synchronised on our secure servers.

Use of these features is subject to the Riot Games Terms of Use.

ARTICLE 14: Weclimb platform and fair play

The weclimb.gg website (the "Weclimb Platform") is operated by Lowdout SASU, which sells directly to its Player customers, in its own name and under the Weclimb brand, competitive video-game coaching services. The material execution of the services is entrusted to selected independent coaches acting as Lowdout subcontractors within the meaning of Articles 20 and 21 of the General Terms and Conditions of Sale. Access to and use of the Weclimb Platform are governed by these Terms and Conditions, without prejudice to the General Terms and Conditions of Sale applicable to paid coaching services.

Definitions. For the purposes of this Article, :

  • Genuine coaching: the transmission by the Coach, in his capacity as a natural person, of knowledge, analyses, advice or exercises designed to improve the User's level of play on the game account held by the User and operated by him personally;
  • Boosting: any service whereby a third party, whether paid or not, plays on the User's behalf, or organises an unbalanced game with the aim of artificially raising the User's ranking;
  • Account sharing: any communication by the User of his/her Riot Games identifiers (e-mail address, password, temporary codes, authentication tokens) to a third party, with the exception of the official authentication tools made available by Riot Games or by Lowdout via the "Riot Sign-On" mechanism.

Good faith undertaking by the User. The User declares and guarantees :

  • that he/she is the legitimate holder of the Riot Games account that he/she associates with the Service, and that he/she operates this account on a strictly personal basis;
  • that he/she is using the services offered on the Weclimb Platform solely for the purposes of genuine coaching as defined herein;
  • that they will not share their Riot Games credentials with a Coach, another User, or any other person outside of the official authentication mechanisms;
  • that it will not solicit, accept or facilitate a boosting service, whether presented as such or disguised as coaching, a live session, a duet or any other form;
  • will not use the Service to circumvent Riot Games Inc. matchmaking rules, code of conduct or terms of use.

Consequences of a breach. Any breach of the above undertakings constitutes a fault on the part of the User which may result, without prejudice to any damages and interest :

  • immediate suspension of the User's access to the Service;
  • automatic termination of the contract between the User and Lowdout ;
  • non-refund of sums paid for services in progress, where the User's fault has prevented the service from taking place or has vitiated its purpose;
  • the signalling of the Riot Games account concerned to Riot Games Inc. in accordance with the commitments made by Lowdout as part of its partnership with Riot Games.

Cooperation with Riot Games. The User acknowledges and agrees that Lowdout is obligated under its own contractual obligations to Riot Games Inc. to notify Riot Games Inc. of any boosting or account sharing behavior that it becomes aware of. This obligation is without prejudice to the User's right to file a claim with Lowdout.

ARTICLE 15: Rating of Weclimb services

At the end of every paid service delivered on the Weclimb Platform (live session, VOD review, session pack), the User-player may award the Coach a score between 1 and 5 stars, accompanied by an optional written comment limited to 500 characters.

Final nature. The rating and the comment are published in a nominative form on the Coach's public profile. To preserve the sincerity of the system, they may neither be modified nor deleted by the User once submitted, save for Lowdout's intervention under the conditions set out in paragraph p5 below.

Rating window. The ability to rate is open for thirty (30) days from the date on which the service was marked as completed by the Platform. Beyond this period, the window closes automatically and the service can no longer be rated. Only one rating is permitted per User and per service.

Honesty of the comment. The User undertakes to provide a sincere, factual and personal appraisal. The following are notably prohibited: insulting, racist, sexist, defamatory or unlawful remarks; misleading or untruthful content; ratings obtained in exchange for consideration; ratings submitted by a User who did not actually benefit from the service; and any concerted manipulation aimed at harming a Coach's reputation.

Moderation. Lowdout reserves the right, upon report or on its own initiative, to hide or delete any comment manifestly contrary to paragraph p4. In the same circumstances, Lowdout may withdraw the corresponding rating and recompute the Coach's average. The withdrawal decision is notified to the User concerned by electronic means.

Prohibition of retaliation. The Coach is expressly prohibited from making the delivery of a service, its price, its content or its quality conditional upon the substance or content of the rating that the User intends to award. Any breach of this prohibition exposes the Coach to the sanctions provided for in the Coach Onboarding Contract and, where applicable, to the termination of the contract binding the Coach to Lowdout.

Aggregated display. The average and the number of ratings obtained by a Coach are made public on the Coach's profile and may be used by Lowdout for algorithmic ranking purposes, for marketplace visibility and for communication. The profile of a Coach with no rating displays a neutral state ("New coach"), with no fictitious average.

Notifications. Lowdout sends the User-player, at the e-mail address associated with the account, an invitation to rate the service within twenty-four (24) hours after its completion, followed by a single reminder seven (7) days later if the service has not been rated. The User may opt out of these solicitations in the account settings; this opt-out does not, however, alter the final nature of any rating actually submitted.

ARTICLE 16: Recording of live sessions and use of recorded content

Purpose and legal basis. Lowdout operates, in the dedicated video conferencing room of each live coaching session organised through the Weclimb Platform, a selective recording mechanism, for the sole purpose of performing the contract between the User and Lowdout (Article 6.1.b of the General Data Protection Regulation) and for the legitimate uses described in paragraph p3 below. Unlike the previous regime, recording is not systematic: the decision to record any given session is taken deterministically and non-retroactively at the moment of booking confirmation, based on the objective criteria listed in paragraph p2.

Recording triggers. A session is recorded if it meets at least one of the following technical criteria, assessed at the time of the Coach's confirmation: (i) it is the first session ever booked between the User-player and the Coach concerned (dispute cover and usage evidence); (ii) the price of the service is greater than or equal to fifty (50) euros including all taxes (cover proportionate to financial risk); (iii) the reliability score of the User-player, within the meaning of Article 17, reaches the warning threshold (16 points) or above (traceability in case of subsequent dispute); (iv) the User-player has an active Premium subscription (contractual entitlement to the replay); (v) the Coach has an active Studio Pro subscription (contractual entitlement to archiving); (vi) prior to the start of the session, the User-player purchases the à-la-carte “recording” add-on priced at one euro ninety-nine (€1.99) including all taxes. This list is exhaustive. Once made, the decision is frozen on the session and cannot be retroactively activated or cancelled. Other sessions are not video-recorded: only the technical connection logs are retained, for the sole purpose of no-show management (Article 13 of the T&Cs of Sale), with no audiovisual content.

Prior information. Before confirming every booking, the User is informed whether the session concerned will be recorded, of the reason retained under paragraph p2, and of the retention period applicable under paragraph p4. This information is displayed on the booking summary page. Continuing the booking process constitutes acknowledgement of this information.

Retention period. The retention period depends on the recording trigger retained under paragraph p2: (i) triggers (i), (ii) or (iii) — evidentiary recording — ninety (90) days from the session, aligned on the regulatory windows for opening a chargeback procedure; (ii) trigger (iv) — recording benefiting a Premium subscriber — for the entire duration of the Premium subscription, extended by a grace period of thirty (30) days from its cancellation; (iii) trigger (v) — recording benefiting a Studio Pro subscriber — for the entire duration of the Studio Pro subscription, extended by a grace period of thirty (30) days from its cancellation; (iv) trigger (vi) — recording acquired à la carte — twelve (12) months from the session. Upon expiry of the applicable period, the recording is purged by a daily automated task. Throughout the retention period, the User has access to the replay and the ability to download it from his personal space.

Use by the Coach for portfolio purposes. The recording of a session may only be reused by the Coach for publication purposes (in particular on social networks, on the Coach's public profile, or in a pedagogical format intended for third parties) after obtaining the express, prior and free consent of the User-player. This consent, distinct from the information referred to in paragraph p3 above, takes the form of an explicit authorisation configurable in the account settings (off by default). The User may at any time withdraw consent for future sessions through the same settings, without prejudice to the use already engaged in respect of sessions for which authorisation had been granted.

À-la-carte purchase. The non-subscribing User-player who wishes to benefit from the replay of a session that would not fall within triggers (i) to (v) may, prior to the start of the session, purchase the recording add-on called “single replay” at the firm price of one euro ninety-nine (€1.99) including all taxes. Payment is made by card via the Platform's payment provider. Should the session become moot by way of cancellation or no-show prior to its start, the add-on is refunded automatically according to Article 13 of the T&Cs of Sale. Should the session effectively start, the add-on is acquired by Lowdout, the consideration having been provided (recording and access to the replay for twelve months).

Player's rights. In accordance with applicable regulations, the User has a right of access to the replay concerning them, a right of rectification where appropriate, a right to object to any use exceeding the strict contractual framework defined in paragraph p1, and a right of erasure upon expiry of the retention period defined in paragraph p4. These rights may be exercised by electronic means at the contact address mentioned in Article 1.

ARTICLE 16 bis: External testimonials

Purpose. In addition to verified ratings arising from a paid prestation effectively performed under Article 15 above, the Weclimb Platform allows a Coach to generate their own shareable link, which they may freely distribute on channels of their choice (in particular Discord, X, channel descriptions) in order to invite third parties to drop a public testimonial on their Weclimb profile. These testimonials are referred to as "external testimonials".

Account required. Filing an external testimonial requires the prior creation of a Lowdout account by the author and acceptance of these terms. Every testimonial is tied nominally to the account that drops it. Only one (1) testimonial per (author, Coach) pair is allowed over the lifetime of the account. Filing a testimonial on one's own profile is impossible.

Relationship with verified ratings. A User who has already filed a verified rating under Article 15 on a given Coach's profile cannot subsequently file an external testimonial on the same Coach. The transactional signal arising from an actual prestation prevails over the declarative and is retained alone.

Display and labelling. External testimonials are published on the Coach's public profile in a section distinct from the verified ratings section, under an explicit label "Témoignage externe" / "External testimonial". They are not counted in the average rating nor in the number of ratings referred to in Article 15, nor in the matchmaking engine referred to in Article 18.

Moderation and invariability. The testimonial is definitive: it may neither be modified nor deleted by its author, under the same conditions as those provided in Article 15.p3 for verified ratings. The Coach has no power to hide or delete a testimonial filed on their profile. Lowdout reserves the right, on its own initiative and at any time, to remove a testimonial that is manifestly fraudulent, false, an affront to the dignity of a third party, or in breach of these terms or applicable law.

Anti-disintermediation. The content of an external testimonial may not include external contact details (in particular Discord, Telegram, WhatsApp, Signal handles, phone numbers, private email addresses) nor outbound links outside a restricted list of reference domains (professional player profiles, ranking platforms, broadcasts). Any testimonial breaching these rules is refused at submission by the system or removed afterwards.

Rotation of the shareable link. The Coach may, at any time and without notice, regenerate their shareable link from their personal area. The regeneration immediately and irrevocably invalidates any link previously distributed. No compensation is owed by reason of such regeneration.

ARTICLE 16 ter : Délais de livraison des reviews VOD et annulation automatique

Champ d'application. Le présent article régit les délais de livraison des prestations de review VOD asynchrones commandées via la marketplace en direct ou via la mise en relation automatisée WeSearch. Il complète l'article 13 des CGV (annulation et remboursement) en ce qui concerne les reviews uniquement.

Délai annoncé par le Coach (marketplace direct). À l'inscription de chaque produit de review VOD, le Coach déclare un délai maximal de livraison parmi un choix encadré, le plus long étant de sept (7) jours calendaires. Ce délai, ci-après dénommé « délai annoncé », est rappelé au Joueur sur la fiche produit et constitue l'engagement contractuel du Coach.

Période de tolérance. Lowdout accorde au Coach une période de tolérance de quarante-huit (48) heures au-delà du délai annoncé. Pendant cette période, la review demeure ouverte et le Coach peut encore la livrer. À titre informatif, le Coach reçoit, au moment où le délai annoncé est atteint, un courrier électronique d'avertissement.

Annulation automatique et remboursement. Si la review n'a pas été livrée à l'expiration de la période de tolérance, soit à délai annoncé + 48 heures, la review est annulée automatiquement par la Plateforme. Le Joueur est alors remboursé à hauteur de cent pour cent (100 %) du prix acquitté, dans les conditions et délais de l'article 13 des CGV. Aucune commission n'est due au Coach.

Voie de la mise en relation automatisée (WeSearch). Pour les reviews soumises via WeSearch, le délai effectif est fixé à quarante-huit (48) heures à compter de l'acceptation par le Coach et ne fait pas l'objet de la période de tolérance prévue au paragraphe p3. À l'expiration de ce délai sans livraison, la review est automatiquement remise dans le pool en vue d'une nouvelle prise en charge par un autre Coach, dans la limite de deux (2) réattributions successives. À l'issue de la troisième tentative infructueuse, la review est annulée et le Joueur intégralement remboursé.

Incidence sur le système de strikes. Chaque livraison effectuée en retard mais avant annulation automatique entraîne l'attribution de deux (2) points au sens de l'article 17. Chaque annulation automatique ou réattribution suite à non-livraison entraîne l'attribution de huit (8) points. Ces points alimentent la mesure de fiabilité du Coach selon les modalités générales de l'article 17.

ARTICLE 17 : Système de prévention des comportements abusifs (« strikes »)

Objet. Afin de garantir le bon fonctionnement de la Plateforme Weclimb et la confiance entre Joueurs et Coachs, Lowdout met en œuvre un système interne de pondération des comportements d'annulation et d'absence, communément désigné « système de strikes ». Ce dispositif s'applique indistinctement aux Joueurs et aux Coachs et n'a pas le caractère d'une sanction disciplinaire.

Événements pris en compte. Donnent lieu à attribution de points : (i) une annulation plus de vingt-quatre (24) heures avant le créneau prévu : un (1) point ; (ii) une annulation entre deux (2) et vingt-quatre (24) heures avant le créneau prévu : trois (3) points (Joueur) ou non comptabilisée (Coach) ; (iii) une annulation moins de deux (2) heures avant le créneau : cinq (5) points ; (iv) une absence non excusée constatée selon les modalités de l'article 13.detection des CGV : huit (8) points ; (v) une absence des deux parties dans les mêmes conditions : quatre (4) points pour chacune.

Fenêtre glissante. Le total des points est calculé sur une fenêtre glissante de trois cent soixante-cinq (365) jours. Les points sortent automatiquement du décompte à l'expiration de ce délai.

Conséquences. Le total de points produit deux effets : (i) un effet algorithmique de pondération de l'éligibilité de l'Utilisateur aux fonctionnalités de mise en relation automatisée (« WeSearch ») dans les conditions de l'article 18 ci-après ; (ii) une notification automatique d'avertissement à l'adresse électronique de l'Utilisateur lorsque son total atteint un seuil de seize (16) puis trente-et-un (31) points sur la fenêtre considérée, à fin d'information et de prévention. Aucun avertissement n'est adressé en deçà du seuil de seize (16) points.

Gel d'accès. Au-delà du seuil de cinquante (50) points sur la fenêtre considérée, ou en cas de cumul d'au moins trois (3) absences non excusées sur une période de quatre-vingt-dix (90) jours, Lowdout se réserve le droit de suspendre temporairement, pour une durée de trente (30) jours, l'accès de l'Utilisateur aux fonctionnalités de mise en relation automatisée. L'accès à la marketplace en mode direct demeure ouvert.

Information et contestation. L'Utilisateur dispose, à tout moment, d'un droit d'accès à son décompte de points depuis son espace personnel, ainsi que d'un droit de contestation par voie électronique à l'adresse contact@lowdout.gg. Lowdout examine la contestation et peut, en cas d'erreur matérielle ou de circonstance exceptionnelle dûment justifiée, procéder au retrait ou à la diminution des points attribués.

ARTICLE 18 : Mise en relation automatisée (« WeSearch ») et décisions algorithmiques

Description. La Plateforme Weclimb met à disposition du Joueur une fonctionnalité de recherche automatisée de Coach, communément désignée « WeSearch », par laquelle le Joueur soumet une demande de session ou de review et le système identifie, parmi les Coachs éligibles, ceux dont le profil correspond le mieux à ses besoins.

Critères pris en compte. Le moteur de mise en relation s'appuie sur des critères objectifs renseignés par le Joueur et par le Coach, et notamment : la ou les langues parlées, le rang du Joueur dans le jeu concerné, la lane ou rôle souhaité, les concepts de coaching demandés, la disponibilité du Coach aux créneaux indiqués par le Joueur, le délai de prise en charge constaté du Coach, et le total de points de l'article 17 ci-dessus.

Intervention humaine. Le résultat produit par le moteur n'a pas le caractère d'une décision individuelle automatisée au sens de l'article 22 du RGPD : le Joueur conserve, à tout moment, la possibilité de consulter la marketplace en mode direct et de choisir lui-même son Coach parmi l'ensemble des Coachs publiés, sans intermédiation algorithmique. Le Coach conserve, de son côté, la liberté d'accepter ou de refuser une demande qui lui est proposée.

Transparence. Sur simple demande adressée à privacy@lowdout.gg, le Joueur peut obtenir des informations utiles sur la logique sous-jacente au résultat qui lui a été présenté lors d'une recherche WeSearch, dans la limite du secret d'affaires et des droits des tiers.

Détection automatique des absences. Lowdout informe l'Utilisateur que l'arrivée des parties dans la salle de visioconférence Daily.co est horodatée automatiquement et que la qualification d'absence non excusée résulte, en première intention, d'un constat algorithmique fondé sur ces horodatages, dans les conditions précisées à l'article 13.detection des CGV. L'Utilisateur conserve la faculté de contester ce constat par les voies prévues à l'article 14 des CGV et à l'article 17.p6 des présentes.

Deux pools de mise en relation. À compter de la mise à jour du 12/06/2026, la fonctionnalité WeSearch repose sur deux pools distincts. Le pool dit « principal » regroupe les Coachs dont l'historique sur la Plateforme satisfait simultanément les seuils suivants : au moins dix (10) prestations terminées, une note moyenne supérieure ou égale à 4,0 sur 5, et un taux de complétion supérieur ou égal à 85 %. Le pool dit « nouveau » regroupe les Coachs dont l'historique satisfait des seuils intermédiaires : au moins trois (3) prestations terminées, un taux de complétion supérieur ou égal à 80 %, et soit une note moyenne supérieure ou égale à 4,0 sur au moins trois (3) notes, soit la justification d'au moins un (1) joueur récurrent. L'attribution au pool est automatique, sans intervention humaine, et révisée en continu à mesure que les métriques évoluent. Le Joueur choisit explicitement, au moment de la demande, dans quel pool sa recherche est dispatchée. Les demandes émises vers le pool nouveau bénéficient d'une réduction tarifaire de vingt-cinq pour cent (25 %) appliquée automatiquement par la Plateforme, en contrepartie de la moindre profondeur d'historique du Coach.

Promotion et rétrogradation. Le passage d'un Coach vers un pool supérieur (du pool nouveau vers le pool principal) est instantané dès lors que les seuils sont atteints. À l'inverse, la rétrogradation vers un pool inférieur n'intervient qu'à l'issue d'une période de tolérance de quatorze (14) jours, durant laquelle le Coach conserve son pool initial le temps de redresser ses métriques. Si les seuils sont à nouveau atteints durant la période de tolérance, la rétrogradation est annulée. À l'expiration de la période sans redressement, la rétrogradation est confirmée.

Mise en pause pour inactivité. À compter de la mise à jour du 12/06/2026, le Coach qui n'a pas consulté sa page de pool sur la Plateforme depuis quinze (15) jours consécutifs est automatiquement mis en pause sur la fonctionnalité WeSearch et cesse d'être proposé aux Joueurs. Un courrier électronique d'avertissement est adressé au Coach deux (2) jours avant la mise en pause effective. Le Coach peut sortir de cette pause à tout moment, par un simple geste manuel sur sa page de pool. La pause pour inactivité n'a pas le caractère d'une sanction et n'affecte pas les autres voies d'accès aux Joueurs (marketplace en direct, communauté, page personnalisable).

Statut Coach Partner. Le statut de Coach Partner, attribué par Lowdout sur la base d'une vérification manuelle individuelle, ouvre un accès automatique au pool principal indépendamment des seuils de l'article 18.p6 ci-dessus. La mise en pause pour inactivité de l'article 18.p8 reste applicable, dans les mêmes conditions, aux Coachs Partner.
